Privacy Policy

Introduction
SimplicitySuite is offered by LayerEight Solutions LLC ("we," "our," or "us"). This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use SimplicitySuite (the "Service"). If you have executed a Master Services Agreement (MSA) and Data Processing Agreement (DPA) with us, those documents control Personal Information we process on your behalf as a processor—including subprocessors, security and breach terms, international transfers, audit cooperation, and deletion—to the extent of any conflict with this Policy for that processing.
For your workspace content (for example, contacts, companies, and deals your team enters), your organization is typically the controller of that business data and decides why and how it is processed; LayerEight Solutions provides the platform and related processing described in your agreements and this Policy.
1. Information We Collect
1.1 Information You Provide
- Account Information: Name, email address, company name, phone number, and billing identifiers when you create or administer an account
- Business Data: Contacts, companies, deals, appointments, and other content you or your users submit to the Service
- Communications: Messages you send us, support requests, and feedback
- Payment Information: Processed by payment providers; we do not store full card numbers on SimplicitySuite servers
1.2 Information Collected Automatically
- Usage Data: Features used and similar product telemetry as needed to operate the Service
- Device and log data: Browser type, IP address, timestamps, diagnostic logs
- Cookies and similar technologies: Including session and security cookies as described in Section 7
2. How We Use Your Information
We use information to:
- Provide, maintain, secure, and improve the Service
- Process billing and send administrative notices
- Respond to support requests and communicate about the Service
- Detect, investigate, and help prevent abuse, fraud, and security incidents
- Comply with law and enforce our Terms of Service and MSA/SOW
We do not sell personal information or workspace data—period. We do not use your workspace data to train generative AI models for unrelated third-party advertising. Uses of subprocessors and analytics are limited to operating and securing the Service and as described in your DPA where it applies.
3. How We Share Your Information
3.1 We Do Not
- Sell personal information or customer business data
- Use your business content for unrelated third-party marketing
- Share your workspace data with competitors
3.2 We May Share Information With
- Service providers and subprocessors: Vendors that host infrastructure, deliver email, process payments, or perform similar functions, under written terms and (where required) your DPA. LayerEight Solutions remains accountable for subprocessors it appoints under the MSA/DPA as stated there.
- Legal and safety: When required by law, regulation, court order, or to protect rights, safety, and security
- Business transfers: In a merger, acquisition, or asset sale, subject to appropriate notice and continuity commitments where required by law or contract
- With your instruction or consent
4. Data Security
We implement administrative, technical, and organizational safeguards appropriate to the Service, such as:
- Encryption of data in transit (TLS) and protection of stored data using encryption where appropriate
- Access controls and authentication
- Monitoring and incident response procedures aligned with our MSA, DPA, and internal policies
- Vendor reviews for categories of subprocessors described in the DPA
No method of transmission or storage is completely secure; supplemental commitments for enterprise clients may appear in your MSA, DPA, or SOW.
5. Data Retention
We retain information while your account is active and as needed to provide the Service. After termination, workspace data is generally retained for 30 days to allow export unless your MSA/SOW specifies a different transition window. Backups may persist for a limited additional period before overwriting. Some records may be retained longer where law, tax, or dispute resolution requires.
6. Your Data and Requests
Your data is yours. We operate SimplicitySuite on your behalf under your agreements; we do not treat your workspace content as our property.
You may request:
- Access to personal information we process about you in connection with the Service
- Correction of inaccurate profile or account information
- Export of your data through product features or support
- Deletion of personal or workspace data consistent with your contracts—see below
For product and account questions, contact privacy@simplicitysuite.app. For ownership, access, correction, export, or removal requests directed to LayerEight Solutions, contact data-request@layereightsolutions.com with enough detail to verify you.
If your organization is a paying customer, clearing production workspace data is part of termination and transitionunder your Master Services Agreement and Statements of Work (including export periods, deletion after offboarding, and records we must retain for billing, taxes, or disputes). End users covered by a customer's DPA may need to work through that customer as controller for some requests.
7. Cookies and Tracking
7.1 Essential Technologies
We use cookies and similar technologies that are strictly necessary for authentication, security, and core functionality.
7.2 Analytics
We may use analytics to understand product usage in aggregate. Analytics are configured to support service improvement and are not used to sell personal data.
7.3 Your Choices
You can control cookies through browser settings; disabling essential technologies may affect login or security.
8. Third-Party Integrations
The Service may connect to third-party services you enable (for example, calendars or payment processors). Those providers process data under their own terms and privacy policies.
9. International Data Transfers
We may process data in the United States and other countries. When we transfer Personal Information across borders, we use safeguards required by applicable law and described in the DPA (for example, standard contractual clauses) where applicable.
10. Children's Privacy
The Service is not directed at individuals under 18. We do not knowingly collect personal information from children. Contact us if you believe we have collected such information in error.
11. Changes to This Policy
We may update this Policy and will post the revised version with an updated date. Material changes may be communicated by email or through the Service. Where your MSA or DPA requires specific notice or consent for material subprocessor or processing changes, we follow those procedures. Continued use after notice may constitute acceptance except where prohibited by your executed agreements.
